Ways of contesting a decision:

-The expressed or non-expressed refuse of the assigned employer of a certain authority or public institution in order to apply the provisions of this law is an infringement and the offender is liable according to law.

-Against the refuse one could file a complaint and submit it to the leader of the authority or the public institution during 30 days from the date the injured party is noticed.

-If, following the administrative investigation, the complaint proved to be substantiated, the answer shall be sent to the injured party during 15 days since the complaint was submitted and will contain the initially requested information of public interest an the administrative sanctions taken against the guilty person.

-In case a citizen considers that his/her rights, provided in this law, are violated, he/she could file a complaint at the administrative contentious section of the tribunal, according to his/her domicile or the headquarters of the public institution. The complaint shall be done in 30 days from the date of expiring of the term provided by art.7 of law.

-The instance could impose on the authority or public institution to provide the requested information of public interest and to pay moral or patrimonial claims.

-The tribunal decision could be appealed.

-The decision of the Court of Appeal is not questionable.

-Both the complaint and the appeal are debated in instance, with no delay.
